Terms of Use

In short

  • Monkr is only for people aged 18 and over.
  • Access to the app requires a subscription that renews automatically. You can cancel at any time in your Apple or Google account settings, at least 24 hours before the end of the current period.
  • Monkr is a tool to help you quit pornography. It is not a medical device and doesn't replace advice from a health professional.
  • Your data stays on your phone (see the Privacy Policy).

1. Purpose

These Terms of Use ("Terms") govern your use of the Monkr mobile app ("the app") and of the subscription that gives access to it. They form the contract between you and the publisher.

By downloading, installing or using the app, you accept these Terms. If you don't accept them, don't use the app.

These Terms apply in addition to the terms of the platform you downloaded the app from (Apple Media Services Terms and Conditions or Google Play Terms of Service). Section 13 sets out the terms Apple requires for apps distributed on the App Store.

The app itself doesn't rely on any server run by the publisher: it works on your phone.

3. Eligibility

The app is only for people aged 18 and over. By using it, you confirm that you are at least 18. The app is for personal, non-commercial use.

You need a compatible device, an Apple or Google account and an internet connection to subscribe or restore a subscription. You are responsible for the security of your device, including its passcode.

The publisher may change these features to improve the service, without substantially reducing what your current subscription includes.

5. Health notice: not a medical device

The app is a personal support tool built on habits and discipline. It is not a medical device. It doesn't diagnose or treat any condition, and it doesn't replace the advice, follow-up or care of a health professional. The addiction index is not a medical diagnosis.

If your habits are causing you distress or you are going through psychological difficulties, talk to your doctor or a qualified professional. If you are in crisis or having thoughts of suicide, contact your local emergency services or a crisis line right away (in France, call 3114, free and available 24/7).

Some program steps suggest physical activity. Adapt them to your condition and ask a doctor if in doubt.

6. Subscription

6.1 Plans

Access to the app's content requires an auto-renewing subscription. The plans available on the date of these Terms are:

Prices, including taxes, are shown in your local currency on the subscription screen before any purchase. In France they are €29.99 per year and €9.99 per month. Prices may vary by country and may change. If a price goes up, you are told in advance under Apple's or Google's rules, and you can cancel before it applies.

6.2 Payment

Payment is charged to your Apple or Google account when you confirm the purchase or, with a free trial, when the trial ends. The publisher never receives your payment details.

6.3 Free trial

Unless you cancel at least 24 hours before the free trial ends, it automatically becomes a paid yearly subscription. The trial is limited to one per account, under Apple's and Google's eligibility rules.

6.4 Automatic renewal

Your subscription renews automatically for the same length, at the current price, unless you cancel at least 24 hours before the end of the current period. The renewal is charged within the 24 hours before the period ends.

6.5 Cancellation

You can cancel at any time, in a few taps, in your account settings:

Cancellation takes effect at the end of the current period, and you keep access until then. Deleting the app does not cancel your subscription.

6.6 Refunds and right of withdrawal

Sales are made through Apple or Google, which handle refund requests under their own terms (Apple: https://reportaproblem.apple.com; Google: Google Play Help Center). Any statutory right of withdrawal is exercised with them, under the conditions they set. The free trial lets you try the app before paying anything.

6.7 Restoring purchases

On a new device using the same Apple or Google account, tap "Restore" on the subscription screen or in the settings to get your subscription back. Your progress data, however, stays on the old device (see section 9).

7. Licence

The publisher grants you a personal, non-exclusive, non-transferable and revocable licence to use the app, for the length of your subscription and for your personal needs.

You may not copy, modify, decompile or disassemble the app, extract its content, get around the subscription or technical protection measures, or use it for unlawful purposes, except where the law expressly allows it.

8. Intellectual property

The app, its name, logo, text, program, design and code are protected by intellectual property law and belong to the publisher or its licensors. No rights are granted to you other than the licence in section 7.

9. Personal data

How your data is handled is described in the Privacy Policy: https://monkr.app/fr/confidentialite.

Your progress data is stored only on your device. The publisher keeps no copy: it is lost if you uninstall the app, erase your data or lose your phone without a backup. The publisher can't restore it.

10. Warranties and liability

If you are a consumer in the European Union, you benefit from the legal guarantee of conformity for digital content and services (in France, Articles L224-25-12 and following of the Consumer Code).

The publisher does its best to keep the app working properly, but can't guarantee it will be free of interruptions or errors. Results depend on your own commitment: the publisher doesn't guarantee any particular outcome.

To the extent permitted by law, the publisher is not liable for damage resulting from use of the app in breach of these Terms, from an incompatible device, from the loss of data stored on your device, or from force majeure. Nothing in these Terms limits the publisher's liability for gross negligence, wilful misconduct or personal injury, or the rights you have under mandatory consumer protection law.

11. Suspension and termination

You can stop using the app at any time. Remember to cancel your subscription (section 6.5).

The publisher may suspend or end your licence if you seriously breach these Terms, in particular by getting around the subscription. If the publisher stops offering the app, it will tell you within a reasonable time and will stop renewing subscriptions.

12. Changes to these Terms

The publisher may change these Terms, for example to reflect changes to the app or the law. The date of the last update is shown at the top of the page. If a change is significant, you are told in the app before it takes effect. If you don't accept it, you can cancel your subscription.

14. Governing law and disputes

These Terms are governed by French law. If you are a consumer living in another country, you keep the protection of the mandatory provisions of the law of your country of residence.

If there is a problem, please contact the publisher first at contact@monkr.app: we always look for an amicable solution. If your written complaint is not resolved, consumers can refer the matter free of charge to the following consumer mediator: [À COMPLÉTER: consumer mediator (name, address and website)].

Failing agreement, the dispute will be brought before the competent courts under the ordinary rules.
